AI and machine learning are rapidly transforming industries.
Healthcare professionals, for example, are turning to AI to analyze medical images and assist with diagnoses. In finance, AI is powering sophisticated trading algorithms and detecting fraud.
Now, companies like Claimbrite are suggesting that their AI-powered platform can streamline personal injury settlements without the help of a lawyer.
While we believe AI is a valuable tool, we want people to be aware of the limitations and risks associated with depending on it.
What is Claimbrite?
If you’re new to Claimbrite, it is a new AI-powered platform that claims to resolve personal injury settlements 80% faster and 90% cheaper than a lawyer.
From what we can gather, this is essentially how the platform works:
- Say, for example, a customer falls in a grocery store and is injured. Either the injured party or the store could suggest using Claimbrite to mediate the settlement in lieu of hiring an attorney
- If both parties agree, they each submit details about the incident on the Claimbrite website
- Claimbrite’s AI system, which has access to over 30,000 data points from multiple insurers’ systems, uses this data to suggest reasonable settlement values
- Claimbrite then acts as a neutral third party, providing an impartial settlement proposal to both parties
- If both parties agree to the AI-proposed settlement, the store (or its insurer) pays the agreed-upon amount to the injured customer. Claimbrite collects a flat $500-1,500 fee for the service
If this is truly how Claimbrite works, we see a slew of potential issues, including:
Lack of Human Judgment
AI can certainly analyze historical data to suggest settlement values. The trouble is it cannot consider the nuances of each case.
For example, factors like mental anguish, the long-term impact of injuries, and other personal injury details may not be present in the captured data. Only an experienced attorney can suss out these critical details, build a case, and argue for an appropriate settlement.
Assuming Both Parties will Agree to Use the Platform
The Claimbrite system can only “work” if both parties communicate with one another and agree to use the platform. If three decades of experience have shown us anything, it’s that:
- Direct communication between two disputing parties is highly problematic, even if that communication is only to decide whether to use the Claimbrite platform
- Disputing parties generally struggle to come to agreements without a human mediator, even when both sides are open to compromising
Potential for Bias
As an experienced legal team, we are incredibly skeptical about the impartiality of the data on which Claimbrite’s AI system is trained. Does that data reflect systemic biases or other inequalities? We don’t know. In fact, we have no idea where that source data comes from.
Lack of Legal Strategy
The Claimbrite platform appears to focus almost exclusively on two things:
- Mitigating conflict
- Closing cases quickly
While we share these goals, we know that achieving the best possible outcome for clients requires a comprehensive legal strategy. This strategy not only takes time but may also require us to push back on opposing parties. Unfortunately, AI offers little assistance in these areas.
Oversimplification of the Legal Process
The Claimbrite platform also painfully oversimplifies the legal process, narrowing it to a data set. Personal injury cases are complex. There are often questions of liability and negligence, and multiple individuals are often involved. The Claimbrite approach does not take this complexity into account.
Lack of Accountability
What happens when Claimbrite users are dissatisfied with their experience? We don’t know, which makes the platform problematic.
Attorneys, on the other hand, have a legal responsibility to act in the best interest of their clients. And if they don’t, they can be held accountable through malpractice claims or bar complaints.
Personal Injury Cases & AI: Our Cautionary Advice
It is worth mentioning that while our criticism is primarily directed at Claimbrite, we also caution personal injury victims from relying on AI-generated legal advice—whether it comes from Gemini, OpenAI, or even AI-powered Google searches.
But why?
AI-generated searches give answers based on the data its platform creators feed it. Unfortunately, in many cases, we do not know where that data comes from. What we do know is that data is often incomplete and inaccurate.
While AI can be useful for cursory overviews, we strongly encourage personal injury victims to consult with an attorney who:
