A DWAI charge arises when officers believe you cannot safely drive your car because of alcohol consumption. The prosecution need not show that you had any specific amount of alcohol in your system. Instead, it is enough to convict you if prosecutors show you had some alcohol in your body and your ability to drive safely was impaired.

Even first-time DUI and DWAI offenders may be sentenced to jail, assessed hundreds of dollars in fines, and ordered to perform community service.

If you have previously been convicted of DUI or DWAI, the penalties will only increase. A first-time DUI conviction also means that your license will be suspended for nine months.
